Mon Arroza LLC Terms & Conditions
Effective Date: October 1, 2025

These Terms & Conditions (“Terms”) constitute a binding agreement between Mon Arroza LLC, a California limited liability company (“Mon Arroza,” “seller,” “we,” “our,” or “us”) and any individual or entity (“Buyer,” “you,” “your,” or “customer”) that purchases products, engages and books our services, or accesses our website.

These Terms and Conditions (“Terms”) govern all transactions, event bookings, orders, and service engagements between Seller and Buyer within the United States. By placing an order, paying a deposit, or engaging Mon Arroza for any service, Buyer agrees to be bound by these Terms.

1. Scope and Application

These Terms apply to all business operations of Mon Arroza LLC conducted within the State of California, including:

  • Booth service (public vendor setup at markets, festivals, or events),

  • Catering service (delivery and handoff of pre-made, sealed rice pudding cups and toppings), and

  • Cart service (pre-paid private event setup with on-site staff service).

These Terms also apply to any transaction conducted through in-person sales, Square POS payments, or invoices issued through Square for event bookings or catering services.

2. Orders, Deposits, and Payments

2.1 Eligibility

All Buyers must be at least 18 years old and legally capable of entering into binding agreements. Orders placed on behalf of a company, group, or event host are considered authorized representations of that entity.

2.2 Placing an Order

To maintain product quality and operational readiness, all catering and cart orders must be placed at least four (4) days in advance of the desired event date.

Customers can initiate an order or booking through any of the following methods:

  1. The Booking page on our official website,

  2. Direct Message through our verified social media accounts,

  3. Call or text our business phone number.

  4. Email us at info@monarroza.com

Once initial contact is made, Mon Arroza will finalize all event details (including date, location, quantity, and service type) and issue an official invoice through Square. The invoice will include a payment link for the deposit and will also serve as formal acknowledgment that the Buyer has read and agreed to these Terms & Conditions.

2.3 Deposits and Balance

A 50% deposit of the total quoted order amount is required to confirm all catering and cart bookings.
Production and preparation will only begin after the deposit has been received and cleared.

The remaining 50% balance is due on the event date prior to or upon delivery/service. Payment can be completed through Square, either online before arrival or in person at the event.

If the Buyer refuses or fails to pay the balance, Seller is under no obligation to begin or continue service and may leave the premises. In such a case, any deposit paid will be forfeited.

2.4 Accepted Payment Methods

Mon Arroza accepts any payment method supported through Square POS and Square Invoices (excluding cash), including credit and debit cards, NFC tap, payment links, and digital wallet options as enabled by Square.

3. Cancellations and Refunds

3.1 Buyer-Initiated Cancellations

  • Extended Notice:
    Cancellations made at least 48 hours before the scheduled event date will receive a full refund of the deposit.

  • Short Notice:
    Cancellations made within 48 hours of the event will not be eligible for any refund.
    In such cases, the deposit is considered a non-refundable mobilization cost that covers the Seller’s time, scheduling, and ingredient preparation.

3.2 Refund Timeline

Refunds are issued within 2–7 business days through Square.
Once processed, the refund is sent to the Buyer’s card-issuing bank, which may take an additional 2–7 business days (depending on the bank’s internal processing). In total, Buyers should allow up to 14 business days for refunds to appear in their accounts.

3.3 Seller-Initiated Cancellations

If Mon Arroza must cancel an order due to an emergency, illness, or unforeseen circumstances, the Buyer will receive a full refund of any deposit or balance paid. No further compensation or liability will apply.

4. Delivery, Travel, and Fees

Mon Arroza’s kitchen is located at 350 Clinton St Ste A, Costa Mesa, CA 92626.

4.1 Delivery Radius

  • A 20-mile radius from the kitchen is considered the standard free delivery zone.

  • Deliveries outside that radius are subject to a flat $10 fee plus $0.50 per driven mile (measured by actual travel distance, not radius).

4.2 Parking and Access

Buyers must ensure Mon Arroza staff have suitable access for unloading, including parking, loading zones, and any required venue permissions. If access is denied, unsafe, or delayed beyond reasonable limits, Mon Arroza reserves the right to refuse service without refund.

4.3 Risk of Loss

For catering orders, ownership and responsibility for the products transfer to the Buyer upon handoff.

5. Services and Event Operations

5.1 Booth Service

Our booth setup requires a 10x10 ft space. A power outlet is not required, but it is preferred. The Buyer or event host must secure all necessary space, permits, and access approvals from the venue or event organizers.

5.2 Catering Service

Catering involves the delivery and handoff of sealed rice pudding cups, along with any packaged toppings. No on-site staffing or serving is included. Once handoff occurs, storage responsibility transfers to the Buyer.

5.3 Cart Service

Cart service is designed for private or pre-paid events. Mon Arroza staff will serve attendees on-site for the booked duration, providing pre-packaged rice pudding cups and toppings as arranged in the purchased order.

5.4 Overtime and Event Extensions

This policy applies to booth and cart services only.
If an event extends beyond the booked timeframe, the buyer will be informed that their time is up. Overtime is charged as follows:

  • Overruns are billed in 30-minute increments, at half of the stated hourly rate.
    Example: If the hourly rate is $50, then each 30-minute overrun costs $25.

  • If payment is handled manually at the event, charges apply in 30-minute increments regardless of actual time overrun.

  • If the Buyer saves a card on file when invoiced, overrun time is billed to the exact minute (e.g., 17 minutes = prorated 17-minute charge).

  • Buyers may also pre-authorize additional time (e.g., 1–2 extra hours) if they anticipate longer service needs.

If the Buyer refuses to pay for overtime, Mon Arroza reserves the right to pack up and leave, without liability for early departure.

6. Food Safety and Allergen Information

6.1 Ingredients

Our rice pudding is made with milk, rice, sugar, and cream.

6.2 Allergens

Products contain dairy and may contain or come into contact with nuts.
Nut toppings are handled separately, but cross-contact may still occur.
Mon Arroza cannot guarantee allergen-free products, and consumption by individuals with allergies is at their own risk.

6.3 Storage and Temperature

After delivery or handoff, all responsibility for storage lies with the Buyer.
Rice pudding must be refrigerated at 40°F (4°C) or below until consumed.
It is best enjoyed the same day, but can remain fresh for up to 7 days if refrigerated.
Mon Arroza is not liable for spoilage, illness, or quality issues arising from improper storage or extended holding times after handoff.

7. Marketing and Communications

7.1 Opt-In Policy

Customers who purchase products from Mon Arroza’s public booth are not automatically added to our marketing list.
However, when you book a catering or cart service and provide your personal and event information for invoicing through Square, it is automatically added to our customer database, and you consent to receive marketing communications as highlighted in our Privacy Policy.

8. Force Majeure

Mon Arroza is not liable for delay or non-performance due to circumstances beyond its reasonable control, including but not limited to illness, equipment failure, ingredient shortages, labor shortages, power outages, pandemics, natural disasters, or government restrictions.
In the event of a force majeure occurrence that prevents order fulfillment, the Buyer will receive a full refund, even if preparation had begun. No further damages or compensation shall be owed.

9. Intellectual Property

All Mon Arroza logos, names, taglines, designs, trade dress, and the slogan “Rice Pudding Made Right” are the exclusive property of Mon Arroza LLC and protected under applicable intellectual property laws.

Any reference to branded toppings (such as cookies or candy) is for identification purposes only. All third-party trademarks and brand names belong to their respective owners, and Mon Arroza LLC is not affiliated with or endorsed by them.

Buyers and third parties are strictly prohibited from using Mon Arroza’s name, logo, or likeness for any commercial or promotional use without our consent.

10. Warranties and Limitation of Liability

All products and services are provided “as is” without warranties of any kind.
To the fullest extent permitted by law, Mon Arroza’s total liability for any claim, loss, or damage arising out of or related to an order or service shall not exceed the total amount paid by the Buyer for that specific order.

Mon Arroza shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, reputation, or enjoyment of the event, even if advised of such possibilities.

11. Dispute Resolution and Governing Law

In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation and mediation.
If resolution cannot be achieved through mediation, the matter may be pursued through lawful proceedings.

These Terms are governed by and construed in accordance with the laws of the State of California for state-level disputes, and federal laws of the United States for federal-level disputes, without regard to conflict-of-law principles.

12. Updates to Terms

Mon Arroza may update or modify these Terms at any time without prior notice.
The updated version will be published on our website and will take effect immediately upon posting for new orders.
For existing confirmed orders, the version effective on the date of deposit payment will apply unless otherwise agreed in writing.

13. Acknowledgment

By paying a deposit or signing an invoice, Buyer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
All invoices issued by Mon Arroza through Square include an acknowledgment or consent checkbox that confirms the buyer’s agreement.

14. Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms (together with any quote, order confirmation, or invoice issued by Seller and any policies expressly incorporated by reference) constitute the entire agreement between Mon Arroza LLC (Seller) and the Buyer regarding the subject matter hereof and supersede all prior or contemporaneous understandings, proposals, negotiations, or communications, whether oral or written. No additional or conflicting terms contained in any purchase order, email, or other document provided by Buyer shall apply unless expressly agreed in a signed writing by Seller.
